Terms of Service

These Terms of Service ("Terms") govern your access to and use of the AirBuild platform, including the website, web application, API, and any related services (collectively, the "Service") operated by Increatech Business Solution Pvt Ltd, a company incorporated under the laws of India, having its registered office at Coimbatore, Tamil Nadu, India ("AirBuild", "we", "us", or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

1. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements.

2. Accounts

2.1 Account Creation

You must provide accurate, current, and complete information during registration and keep it updated. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

2.2 Organizations

The Service is organized around organizations. The user who creates an organization becomes its owner and may invite other members. The owner and admins are responsible for managing member access and ensuring compliance with these Terms.

2.3 Account Suspension

We reserve the right to suspend or terminate accounts that violate these Terms, applicable laws, or our Acceptable Use Policy. We may also suspend accounts for non-payment or suspicious activity.

3. Acceptable Use

You agree not to use the Service to upload, store, distribute, or otherwise process any content that is illegal, harmful, infringing, or malicious. This includes but is not limited to content that violates intellectual property rights, contains malware or viruses, infringes on privacy rights, or is prohibited under Indian law or the laws of your jurisdiction. 4. Plans, Billing, and Payment

4.1 Subscription Plans

We offer various subscription plans with different features and limits. Plan details, pricing, and features are displayed on the Service and may change from time to time. Any changes to pricing will be communicated in advance.

4.2 Billing

Subscription fees are billed in advance on a recurring basis (monthly or annually) through our payment processor, Razorpay. You authorize us to charge the selected payment method for all fees associated with your subscription.

4.3 Trials

We may offer free trials for certain plans. Trials allow access to premium features for a limited time. At the end of the trial period, your plan will automatically convert to the FREE plan unless you subscribe to a paid plan.

4.4 Downgrades

You may downgrade your plan at any time. Downgrades take effect at the end of the current billing period. If your usage exceeds the limits of the new plan, certain features may be restricted until usage is reduced or the plan is upgraded again.

4.5 Refunds

Refunds are governed by our Refund Policy. Subscription fees are generally non-refundable except as required by law or as stated in the Refund Policy.

4.6 Taxes

Fees are exclusive of applicable taxes, including GST (Goods and Services Tax) as applicable under Indian law. Where required, taxes will be added to your invoice at the applicable rate.

5. Build Files and Content

5.1 Your Content

You retain all ownership rights to the build files (IPA, APK) and other content you upload to the Service. By uploading content, you grant us a worldwide, non-exclusive license to store, process, and distribute your content solely for the purpose of operating the Service.

5.2 Security Scanning

We scan all uploaded build files for malware and known threats before storing them. We reserve the right to reject or remove files that are flagged as malicious.

5.3 Storage and Retention

Build files are stored for the duration of your subscription. If your subscription is canceled or terminated, we will retain your data for 30 days before permanent deletion, unless legally required otherwise.

6. Intellectual Property

6.1 Our Rights

The Service, including its design, software, branding, and content (excluding user-uploaded content), is the intellectual property of Increatech Business Solution Pvt Ltd and is protected under Indian and international intellectual property laws.

6.2 Trademarks

"AirBuild", the AirBuild logo, and related marks are trademarks of Increatech Business Solution Pvt Ltd. You may not use these marks without our prior written consent.

6.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, we may use them without any obligation to you.

7. API Access

API access is provided as part of certain subscription plans. API keys are tied to your organization and must be kept secure. You are responsible for all API usage under your keys. We may rate-limit or restrict API access to ensure fair usage and service stability.

8. Webhooks and Integrations

The Service may support webhooks and third-party integrations. You are responsible for configuring these integrations and ensuring they comply with the terms of the third-party services involved.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. Your use of the Service is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, Increatech Business Solution Pvt Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business, arising out of or related to the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

Our total aggregate liability for all claims arising out of or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or ₹5,000 (INR), whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless Increatech Business Solution Pvt Ltd, its directors, officers, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

You may terminate your account at any time by canceling your subscription and deleting your organization. We may terminate or suspend access immediately, without prior notice, for any violation of these Terms or upon legal request.

Upon termination, all licenses granted to you will cease. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will remain in effect.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising out of or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Coimbatore, Tamil Nadu, India. The parties shall attempt to resolve disputes amicably before initiating litigation.

14. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes via email or in-app announcement at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
